The Client confirms that they have been informed of the nature of the treatment, the possible risks, and any potential benefits. The Client gives their consent for UK HEKAS LTD to provide the agreed treatment.

2. Medical Information and Client Responsibility

  • Any other health concerns that may affect treatment safety or suitability

The Client agrees to inform the Therapist immediately of any changes to their medical condition or if they experience pain, discomfort, dizziness, adverse reactions, or any unusual symptoms during or after treatment.

The Client understands that failure to disclose relevant medical information may affect the safety and effectiveness of treatment. UK HEKAS LTD shall not be held liable for any injury, reaction, complication, or adverse outcome resulting from undisclosed, incomplete, inaccurate, or misleading medical information provided by the Client.

3. Booking and Payment

Appointments are subject to availability and are only confirmed once booked through the approved booking process.

UK HEKAS LTD may require payment in advance, a deposit, or full payment at the time of booking. Where payment is due before treatment, the appointment may not be confirmed until payment has been received.

The Client agrees to pay all applicable fees for the services booked.

4. 72-Hour Cancellation and Rescheduling Policy

The Client must provide at least 72 hours’ notice to cancel or reschedule an appointment.

Where less than 72 hours’ notice is provided, UK HEKAS LTD reserves the right to charge the full appointment fee or retain any deposit or advance payment made.

UK HEKAS LTD understands that emergencies may occur and may, at its sole discretion, waive or reduce cancellation charges in exceptional circumstances.

5. Late Arrival Policy

Clients are expected to arrive on time for their appointment.

If the Client arrives late, the treatment time may be reduced to avoid delaying other clients. The full appointment fee will still apply.

If the Client arrives significantly late, UK HEKAS LTD reserves the right to cancel the appointment and treat it as a late cancellation.

6. Waiver and Release of Liability

To the fullest extent permitted by law, the Client waives, releases, and discharges UK HEKAS LTD, its employees, agents, contractors, affiliates, and representatives from any and all liability, claims, demands, actions, causes of action, losses, damages, or expenses arising out of or in connection with the treatments provided.

This includes, but is not limited to:

  • Bruising, burns, scars, infection, or skin irritation resulting from dry or wet cupping
  • Soreness, discomfort, or soft tissue injury resulting from instrument-assisted soft tissue mobilisation
  • Muscle or joint strains, sprains, or injuries resulting from stretching procedures
  • Aggravation or worsening of pre-existing injuries or medical conditions
  • Any adverse reactions connected to the treatment provided

This waiver applies to both known and unknown risks, and to both foreseeable and unforeseeable circumstances.

The Client acknowledges that, by agreeing to these Terms and Conditions, they are voluntarily waiving their right to bring a personal injury claim or legal action against UK HEKAS LTD for injuries or adverse effects arising from participation in sports therapy treatments, except where such liability cannot be excluded by law.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under the laws of England and Wales.

7. Limitation of Liability

The Client acknowledges that UK HEKAS LTD does not guarantee any specific outcome, improvement, recovery, or benefit from the treatments provided.

The Client understands that individual responses to treatment vary and that there may be no immediate or guaranteed improvement in their condition.

To the fullest extent permitted by law, UK HEKAS LTD shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of earnings, loss of opportunity, pain and suffering, emotional distress, or mental anguish arising from or related to the treatment provided.

8. No Medical Diagnosis

The Client understands that sports therapy treatments provided by UK HEKAS LTD are not a substitute for medical diagnosis, medical treatment, or advice from a qualified doctor or healthcare professional.

The Therapist does not diagnose medical conditions, prescribe medication, or provide medical advice.

The Client is responsible for consulting a qualified medical professional where they have concerns about their health, symptoms, injuries, or suitability for treatment.

9. Indemnification

The Client agrees to indemnify and hold harmless UK HEKAS LTD, its employees, agents, contractors, affiliates, and representatives from any claims, actions, liabilities, damages, costs, or expenses arising from the Client’s own actions, omissions, negligence, failure to disclose medical information, or failure to follow advice or aftercare instructions.

This includes any third-party claims connected to the Client’s conduct before, during, or after treatment.

10. Voluntary Participation and Right to Refuse Treatment

The Client acknowledges that participation in treatment is voluntary.

The Client has the right to refuse, pause, or discontinue treatment at any time. If the Client chooses to decline or discontinue treatment, they agree to inform the Therapist as soon as possible.

UK HEKAS LTD also reserves the right to refuse, stop, or modify treatment where the Therapist believes it is unsafe, unsuitable, inappropriate, or not in the Client’s best interests.

11. Aftercare

The Client agrees to follow any aftercare guidance provided by the Therapist.

The Client understands that failure to follow aftercare advice may increase the risk of soreness, irritation, bruising, delayed recovery, or other adverse effects.

The Client should seek medical attention if they experience severe pain, unusual symptoms, signs of infection, or any concerning reaction after treatment.

12. Personal Belongings

The Client is responsible for their own personal belongings while attending appointments.

UK HEKAS LTD accepts no liability for loss, theft, or damage to personal property unless caused by the negligence of UK HEKAS LTD.

13. Privacy and Confidentiality

UK HEKAS LTD will handle Client information in accordance with applicable data protection laws.

Client medical and personal information will be treated as confidential and used only for purposes connected to treatment, administration, booking, payment, legal compliance, and client care.
